Phones while driving

Fines and points

Holding or using a phone while driving is illegal in every state and territory. That includes at a red light and in traffic.

  • A phone in a fixed mount that you do not touch is generally allowed. Hands-free or Bluetooth calls are generally allowed.
  • Learner and provisional drivers cannot use a phone at all in NSW, Queensland, South Australia, Tasmania and Victoria.
  • Fines and demerit points differ by state, and the fines are large.

Rules for this one differ by state. Pick your state on the Local laws and customs page to see yours.
